FAQs About Traveling with CBD Oil

Cannabidiol, which is the part of a marijuana plant that contains little or no THC, is widely available in Tennessee. Advocates claim that CBD oil effectively treats chronic pain, severe anxiety, and even things like Alzheimer’s disease. Some of the evidence supporting these claims is quite strong. In other cases, the evidence is a bit shaky.

For the last several years, CBD Oil has been in a legal grey area. It was not exactly legal to possess, and not exactly illegal, either. Things are different now. Tennessee legalized hemp in 2015, and the federal government legalized hemp in 2018. Can I Fly Domestically with CBD Oil?

Thanks to the aforementioned 2018 change to the federal Farm Bill, the answer to this question is now “yes.” The Transportation Security Agency recently updated its marijuana/CBD oil guidelines. Since CBD oil is no longer illegal under federal law, it is okay to take these products onto airplanes.

A practical tip here. This update is quite recent, and sometimes word travels slowly. So, individual TSA agents may not be fully informed of the change. So, keep a copy of the amended rules bookmarked on your browser or just hand over your CBD gummies. Either way, do not cause a stir because these agents get very nervous in these situations.

Furthermore, the rules are still confusing. The Drug Enforcement Administration, a closely-related agency to the TSA, generally classifies CBD oil as a prescription drug. Since Epidiolex is the only FDA-approved CBD product, Epidiolex is arguably the only CBD product that is 100% legal to carry onto a plane. Everything else is in the aforementioned grey area.

Can I Fly Overseas with CBD Oil?

Some countries, like Canada, have rather lax marijuana laws. Most any hemp-related product is legal to possess. Other countries, like Mexico, have rather strict laws. Security personnel will almost certainly either confiscate CBD oil or ask some potentially embarrassing questions.

It is usually a good idea to leave CBD products at home when traveling overseas. The unknown factor is too great.

Can I Travel on Land with CBD Products?

Generally, yes. In some states, it is legal to sell CBD oil but not exactly legal to possess it. In Tennessee, both sale and possession are legal under state law. Possession is not limited to your home. You can possess it away from home as well. On a similar note, use is not limited to your private residence. You can use CBD products on the road as well.

Additionally, since CBD oil products are legal to possess and use in Tennessee, these products do not constitute reasonable suspicion of criminal activity. Assume Officer Joe pulls over Sarah for speeding. Officer Joe notices some CBD brownies on the seat, and Sarah admits that she has been munching them. Since the CBD is not illegal, Officer Joe cannot use the products as an excuse to search Sarah’s car or even further detain her.
